Michigan’s Clean Slate law, implemented on April 11, 2023, has created challenges for the background screening industry. With the law in place, criminal records are now automatically expunged if specific conditions are met, which is fantastic to allow individuals with criminal histories a second chance. However, the implementation process has created headaches for Consumer Reporting Agencies (CRAs) and background screening companies.
Since implementation started back in April of this year, several courts across the state have removed public access to their criminal indexes or significantly reduced the available years to search. This has resulted in restricted access to criminal indexes and considerable delays in retrieving crucial case information, causing uncertainty and frustration.
