Delaware, famously known as “The First State,” is on the verge of a significant legal transformation with the implementation of its Clean Slate law, set for August 1st, 2024. This legislation marks a major step forward in criminal justice reform by automating the record clearance process, making it more equitable and efficient.

Delaware’s Clean Slate Law
Delaware’s Clean Slate law was signed by Governor John Carney on November 8, 2021. The two pieces of legislation—Senate Bill 111 and Senate Bill 112—expanded access to Delaware’s mandatory expungement process, effective January 1, 2022.

Implementation of an automatic record clearance process for eligible records is set for August 1, 2024, and will replace the petition-based process. Over 290,000 individuals in Delaware are eligible to benefit from this streamlined expungement process.
